These Terms govern your use of the TakeOver applications (Android, iOS and the desktop server) and this website. By downloading, installing or using TakeOver, you agree to them.
1. Acceptance
By installing or using TakeOver (the “Software”) or this website, you agree to these Terms of Service (“Terms”). If you do not agree, do not install or use the Software.
2. What TakeOver is
TakeOver lets a phone or tablet you control act as a remote for a computer you control — trackpad, keyboard, screen mirror, audio, camera, file transfer and related features — over your local network or, optionally, over the internet using a peer-to-peer connection. The Software connects your own devices to each other. You are responsible for the devices you pair and the network you use.
3. Licence
Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on devices you own or control. You may not: (a) resell, rent or sublicense the Software; (b) reverse engineer it except to the extent that restriction is prohibited by law; (c) remove or alter any notices; or (d) use it to build a competing product.
4. Authorised use only
TakeOver is a powerful remote-control and monitoring tool. You may only use it on devices, networks and cameras that you own or are explicitly authorised to control and monitor. Using it to access a device, network or camera without the owner’s informed consent may be illegal.
You are solely responsible for obtaining any consents required by law (including for recording, screen capture, camera monitoring or audio) in your jurisdiction.
5. Acceptable use
Your use is also subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.
6. No accounts
TakeOver has no user accounts, sign-up or profiles. Pairing is established directly between your devices and secured by an on-device approval step. We do not issue or manage credentials on your behalf. See our Privacy Policy.
7. Third-party components & services
The Software may rely on third-party components and services (for example, a connection-brokering service and TURN relays used only to help your devices find and reach each other over the internet, and standard open-source media libraries). Your use of those services may be subject to their own terms. The Software is not affiliated with or endorsed by Microsoft, Apple, Google, or any hardware or camera vendor; product names are the property of their respective owners.
8. No warranty
The Software and website are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including fitness for a particular purpose, merchantability, non-infringement, reliability, or uninterrupted or error-free operation. You use the Software at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, the Operator and its contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or device availability, arising out of or relating to your use of (or inability to use) the Software or website. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above. Continued use after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the country in which the Operator is established, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection rights available to you where you live.
